Terms of Use

Systemic & Sustainable by Design™ is a framework and product suite developed by Transformative Solutions in Education, LLC. The Site provides educational leaders and district professionals with access to the SSBD™ framework, the Systemic Engagement Quick Scan self-assessment tool, the SSBD™ newsletter, and related professional learning resources.

SSBD™ is not a program. It is a framework and product suite. All framework content, tools, indicator sets, scoring rubrics, and materials are proprietary to Transformative Solutions in Education, LLC.

The Site and its tools are designed for adult educational leaders, district professionals, and individuals engaged in the field of family and community engagement in education. By using the Site, you represent that you are at least 18 years of age.

Access to the Systemic Engagement Quick Scan and the SSBD™ newsletter requires registration for a free SSBD™ membership. By registering, you agree to:

• Provide accurate and current information at registration
• Maintain the confidentiality of any account credentials
• Notify us of any unauthorized use of your account at info@systemicbydesign.org

Free membership includes access to the Systemic Engagement Quick Scan and the SSBD™ newsletter. Additional features, including the Navigator platform and professional learning modules, will be available through paid tiers in future phases.

The Systemic Engagement Quick Scan is a professional self-assessment tool built to protect your privacy by design. The following terms apply to its use:

All content on the Site, including but not limited to the SSBD™ framework, Quick Scan questions and scoring rubric, Navigator indicators, written materials, design elements, and organizational structure, is the exclusive intellectual property of Transformative Solutions in Education, LLC, and is protected by United States copyright law and applicable intellectual property statutes.

Unauthorized use of SSBD™ intellectual property may result in legal action. For licensing inquiries, contact info@systemicbydesign.org.

Systemic & Sustainable by Design™ is a trademark of Transformative Solutions in Education, LLC. Nothing in these Terms grants you any right to use the SSBD™ name, trademark, or logo without prior written permission.

You agree not to use the Site to:

• Violate any applicable law, regulation, or professional standard
• Transmit harmful, offensive, or misleading content
• Attempt to gain unauthorized access to any part of the Site or its systems
• Scrape, harvest, or systematically collect data from the Site
• Impersonate TSE, SSBD™, or any individual associated with either
• Interfere with the integrity or performance of the Site

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy is available at systemicbydesign.org/privacy-policy. We do not sell member data under any circumstances.

The Site and all content, tools, and services are provided on an "as is" and "as available" basis. Transformative Solutions in Education, LLC makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for any particular purpose of any Site content or assessment results.

Quick Scan results and all framework tools are provided for professional development and self-reflection purposes only. TSE does not warrant that the tools will meet every user’s needs or produce any particular outcome.

To the fullest extent permitted by applicable law, Transformative Solutions in Education, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site or its tools.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid, if any, for access to the applicable service during the 12 months preceding the claim.

You agree to indemnify and hold harmless Transformative Solutions in Education, LLC, its principal, agents, and service providers from any claims, damages, or expenses (including reasonable attorney’s fees) arising from your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

We reserve the right to suspend or terminate your access to the Site or membership account at our discretion, with or without notice, if we determine that you have violated these Terms or used the Site in a manner that is harmful to TSE, SSBD™, or other users.

You may also request termination of your account at any time by contacting info@systemicbydesign.org.

The Site may contain links to third-party websites or reference external services. These links are provided for convenience only. TSE does not endorse, control, or assume responsibility for any third-party content or services. Your use of third-party sites is governed by their own terms and policies.

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Suffolk County, Massachusetts, and you consent to jurisdiction in those courts.

We may update these Terms from time to time. Material changes will be communicated to registered members by email. The "Last Updated" date at the top of this document will reflect the most recent revision. Your continued use of the Site following notice of changes constitutes acceptance of the updated Terms.
