This Privacy Policy describes how Transformative Solutions in Education, LLC ("TSE", "we", "our", or "us"), the developer of Systemic & Sustainable by Design™ ("SSBD™"), collects, uses, protects, and handles information about visitors and members of systemicbydesign.org (the "Site"). By accessing or using the Site, you agree to the practices described here.

This commitment is absolute and unconditional. Your data is collected solely to provide, improve, and communicate about SSBD™ products and services.

A. Information You Provide Directly

  • Name and email address when you register for a free SSBD™ membership
  • Professional role or district affiliation, if voluntarily provided
  • Messages sent to us through contact forms or email

B. Information Collected Automatically

  • Pages visited, time on site, and navigation patterns (via aggregated analytics)
  • Browser type, device type, and general geographic region
  • IP address (used for security and abuse prevention only)

C. Information We Do Not Collect

  • Social Security numbers, government-issued identification, or financial account details
  • Student data of any kind
  • Sensitive personal information beyond what is listed above

How We Use Your Information

We use collected information only for the following purposes:

  • To create and manage your free SSBD™ membership account
  • To deliver the SSBD™ newsletter and communications you have opted into
  • To respond to your questions or support requests
  • To improve the Site, tools, and user experience
  • To comply with applicable legal obligations

We do not use your information for automated profiling, behavioral advertising, or any purpose not listed above without your explicit consent.

Systemic Engagement Quick Scan Data

The Systemic Engagement Quick Scan is a professional self-assessment tool. Your privacy in this tool is protected by design.

Systemic Engagement Quick Scan — Privacy by Design

Your responses are never collected, stored, or shared.

  • The Quick Scan does not collect, transmit, or store your responses. Responses are processed to generate your results and are not retained by TSE or any third-party system.
  • Results are displayed as a one-time snapshot. Once you close or navigate away from the results screen, your responses and results are permanently gone and cannot be retrieved.
  • You are responsible for saving or recording your results if you wish to retain them for your own use.
  • No individual Quick Scan response is ever associated with your membership account, stored in a database, or linked to your identity.
  • Quick Scan responses are never shared with any third party in any form.

If TSE uses aggregate, de-identified trends to improve the tool in the future, no individual response will ever be identifiable in that process. Any such use will be disclosed in an updated version of this policy.

Email Communications and Kit (ConvertKit)

SSBD™ uses Kit (ConvertKit) as its email service provider. When you sign up for a free membership or newsletter, your name and email address are transmitted to Kit to enable email delivery. Kit is a U.S.-based email service provider that operates under its own privacy policy, available at kit.com.

We use Kit solely to deliver emails and manage subscriptions. We do not authorize Kit to use your information for any other purpose.

  • You may unsubscribe from SSBD™ emails at any time using the unsubscribe link in any email
  • Unsubscribing from email does not delete your membership account
  • To request full account deletion, see Section 9 below

Sharing of Information

We do not sell, rent, or share your personal information except in the following limited circumstances:

  • Service Providers: We share information with trusted service providers (such as Kit for email delivery and web hosting providers) only as necessary to operate the Site. These providers are contractually prohibited from using your information for any purpose other than providing services to us.
  • Legal Requirements: We may disclose information if required to do so by law, court order, or governmental authority, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of TSE, our members, or others.
  • Business Transfers: In the unlikely event of a merger, acquisition, or asset sale, member data would be subject to the same protections described in this policy. You would be notified before any transfer occurs.

No other sharing occurs. We do not share data with advertisers, data brokers, research firms, or any partner organization for marketing or commercial purposes.

Data Security

We take the security of your information seriously and employ reasonable administrative, technical, and physical safeguards, including:

  • Encrypted data transmission (HTTPS/TLS) for all Site activity
  • Access controls limiting who within TSE can view member data
  • Use of reputable third-party platforms with their own security practices

No system is completely secure. In the event of a data breach that may affect your rights, we will notify affected members in accordance with applicable law.

Cookies and Tracking

The Site may use cookies and similar technologies to support basic site functionality, remember login sessions, and collect anonymized usage analytics. We do not use tracking cookies for advertising or cross-site behavioral tracking.

You may configure your browser to refuse cookies. Note that some Site features may not function properly if cookies are disabled.

Children’s Privacy

The Site and SSBD™ tools are designed for adult educational leaders and district professionals. We do not knowingly collect information from individuals under the age of 18. If we become aware that a minor has provided personal information, we will delete it promptly.

Transformative Solutions in Education, LLC is a Massachusetts limited liability company. Massachusetts residents have rights under the Massachusetts Data Privacy Law and related consumer protection statutes. To exercise your data rights, contact us at info@systemicbydesign.org.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will notify registered members by email. Your continued use of the Site after any change constitutes acceptance of the updated policy.
